This contribution is to analyze through a comparative perspective, the recent constitutional reforms in Spain and in Italy in terms of budgetary stability. The common context of serious economic and financial crisis, such as the summer of 2011, and its introduction by the Treaty on European Fiscal Compact urged both countries to establish, within their documents, the principle of a balanced budget. However, there are different complicated aspects related to these reforms, including the pacing of the constitutional amendments, especially with regard to Spain, which has raised some concerns about the respect owed to the Democratic principle. At the same time, there are also tensions due to the Welfare State, as the Spanish and Italian constitutional news have sought indebtedness, to attain fiscal stability through the prohibition of the use, at least in a general way, by a choice essentially similar and rather unambiguous. The survey focuses, therefore, on the consequences relating to the protection of social rights, taking into account the common model of a social market economy as ratified by the European Union Treaty.
