The tax implications of the transfer of works of art between private individuals are still not fully clarified in Italian law, and over time, interventions in doctrine, jurisprudence, and tax administration have been necessary to resolve uncertainties. The law implementing the tax reform established, among other things, rules regarding capital gains realized by collectors not motivated by speculative intent, as well as those more broadly applicable to works of creative genius in the field of visual arts, excluding them from taxation. Furthermore, the enabling act, in compliance with a European directive, contemplates changes to the applicable VAT rate, among other things, to imports of works of art. This aspect, along with the tax regulations, has recently been implemented. Consequently, some implications for the regime applicable to such transfers remain to be regulated to eliminate any doubts that may arise regarding these forms of wealth in relation to the contributory capacity referred to in Article 53 of the Constitution.

Abstract
Consequently, some implications for the regime applicable to such transfers remain to be regulated to eliminate any doubts that may arise regarding these forms of wealth in relation to the contributory capacity referred to in Article 53 of the Constitution.I documenti in IRIS sono protetti da copyright e tutti i diritti sono riservati, salvo diversa indicazione.
