The essay analyzes the evolution of sexual criminal law from the paradigm of coercion to the principle of consent, reconstructing the centrality of sexual self-determination as a personal and inviolable legal asset, also in light of bioethical reflections on the body, freedom, and dignity. Combining normative analysis and a historical-legal approach, through jurisprudential sources from the late nineteenth and early twentieth centuries, the contribution shows how sexual violence constitutes a direct violation of personal freedom and how judicial practices reflect persistent cultural legacies that affect the ascertainment of dissent and the effectiveness of criminal protection of the victim.
