The article aims at examining the potential role of the European Court of Human Rights in strengthening States’ cooperation with the International Criminal Court and in protecting victims of international crimes. To this end, it offers a critical analysis of the enforcement mechanisms provided for under the Rome Statute in cases of non-compliance, on the one hand, and of the European Court’s case law on the procedural obligations to cooperate arising from Articles 2 and 3 of the ECHR, on the other, taking the Almasri case as a starting point. It argues that failures to cooperate with the ICC may, in certain circumstances, constitute a violation of these procedural obligations, thereby allowing victims of international crimes to invoke the ECHR system as an indirect enforcement mechanism, thus reinforcing the effectiveness of international criminal justice and enhancing victims’ access to remedies.
