The article addresses the protection requirements of public goods employed in the fulfillment of fundamental human rights. It emphasizes that, in addition to preventing their depletion, certain goods must be safeguarded for the benefit of future generations. The constitutional framework, particularly following recent amendments, appears to conflict with the provisions of the Civil Code regarding public goods. Specifically, the current legal regime fails to conclusively prevent the exhaustion of such goods and does not adequately guarantee effective protection of the rights of future generations, thereby revealing significant shortcomings in the existing legal safeguards.
