LE “COMUNITÀ ENERGETICHE” COME NUOVI MODELLI GIURIDICI DI SVILUPPO SOSTENIBILE. PRIME NOTE SULL'ESPERIENZA FRANCESE

Lo sviluppo sostenibile nell'era dell'Antropocene è un valore fondamentale del nuovo ambientalismo globale. L'obiettivo delle "comunità energetiche" ha assunto un significato straordinario in quanto I cittadini di tutto il mondo hanno acquisito rilevanza nel settore energetico anche attraverso azioni dirette e partecipative volte a costruire una società più equa e sostenibile. Le “comunità energetiche” sono perciò nuovi modelli giuridici di sviluppo sostenibile diffusi in tutti i paesi europei in attuazione della normativa europea. Nel diritto francese, le norme sulla transizione ecologica ed energetica sono previste dalla legge 2019-1147 dell'8 novembre 2019 relativa all'energia e al clima e questa legislazione ha integrato e modificato il Codice dell'Energia. Nel 2022, la Francia conta 515 comunità energetiche di cittadini, inclusa la stragrande maggioranza degli impianti fotovoltaici (94%) che rappresentano ancora il 50% della produzione totale di elettricità.

Sustainable development in the Anthropocene era is a fundamental value of the new global environmentalism. The goal of "energy communities" has taken on extraordinary significance as citizens from all over the world have acquired relevance in the energy sector also through direct and participatory actions that aim at building a more equitable and sustainable society. The "energy communities" are new legal models of sustainable development widespread in all European countries in implementation of European legislation. In French law, the regulations on ecological and energy transition are provided for by law 2019-1147 of 8 November 2019 relating to energy and climate and this legislation has integrated and amended the Energy Code. In 2022, France has 515 energy communities of citizens, including the vast majority of photovoltaic systems (94%) which still represent 50% of total electricity production.
