Il ruolo della giurisdizione nell'attuazione delle sentenze additive di prestazione della Corte Costituzionale

The work deepens the evolution of constitutional jurisprudence on essential levels of health care with particular attention to additive judgments by which the Constitutional Court declares the constitutional illegality of the legal rules in so far as they do not provide for the financial coverage of the essential levels of benefits. In particular, the work addresses the complex problem of the concrete implementation of additive performance judgments. Hence the attempt to overcome the stalemate that is being created, as a result of the legislator's inaction on the financing of essential levels of health care, once the additive judg-ments have been delivered by the Constitutional Court. The analysis of the "liv-ing right" leads the author not only to the interpretation of the rules of law according to the Constitution but also to the implementation of the judgments of the Constitutional Court. This is in order to achieve, in the name of loyal coop-eration between common judges and constitutional judges, the guarantee of ef-fective protection of incomppressible fundamental rights.

Il lavoro approfondisce l’evoluzione della giurisprudenza costituzionale in tema di livelli essenziali delle prestazioni sanitarie con particolare attenzione alle sentenze additive con le quali la Corte costituzionale dichiara l’illegittimità costituzionale delle norme di legge nella parte in cui non prevedono la copertura finanziaria dei li-velli essenziali delle prestazioni. In particolare, il lavoro affronta il complesso problema della attuazione concreta delle sentenze additive di prestazione. Di qui il tentativo di superare la situazione di stallo che si viene a creare, a seguito dell’inerzia del legislatore in materia di finanziamento dei livelli essenziali delle prestazioni sanitarie, una volta emanate le sentenze additive da parte della Corte costituzionale. L’analisi del “diritto vivente” porta l’autore non solo alla interpretazione delle norme di legge secondo la Costituzione ma, anche, alla attuazione delle sentenze della Corte costituzionale. E ciò per realizzare in nome di una leale collaborazione tra giudici comuni e giudici costituzionali la garanzia di una effettiva tutela dei diritti fondamentali incomprimibili.
