The author in this article aims to highlight that the recognition of the legitimacy of the constitutive conflict of the social implies a political stasiology that assumes the constituent power of the people, as a permanent institutive power of hegemonic re-articulation of the political representation of society, starting from the representational transcendence of subjectivity, as stasis at the origin of all political antagonism. And it is only in a radical declination of democracy, which assumes political conflict as a condition of its political articulation, that the representational unrealization of constituent power is made explicit, that is, the ontological indeterminacy of the social of which the political is the symptomatic trait that escapes any constitutionalist crystallization of the political.
