Recently, doctrine has questioned whether the new cases of civil liability for artificial intelligence can be brought within the scope of certain non-contractual liability models provided for by our legal system and specifically whether, in certain cases, Article 2051 of the Civil Code is applicable, in light of the principles developed in case law. The contribution highlights how the codified regulation of liability for things in custody is still subject to innovative jurisprudential interpretations with reference to the nature of liability, so as to outline polyhedric schemes.
