Considerazioni in tema di vincoli di bilancio e tutela del diritto alla salute

The essay analyzes the difficult relationship between budgetary constraints and health protection in the context of institutional pluralism of the health organization. The double dimension, personal and collective, of the right to health has shown new reflections during the pandemic crisis and has highlighted the difficulties of coordination related to the distribution of regulatory and administrative competences in the health system. Identifying an appropriate balance between the universality and globalism of the protection and available financial resources is particularly delicate. These difficulties are reflected in the financial relations between the State and Regions in the field of health, an important aspect for the implementation of the new health organization in fulfillment of the reforms provided for in the National Recovery and Resilience Plan (PNRR). Taking advantage of the pandemic experience, a system can be set up to ensure the best allocation of resources in the interest of the community.
