The case at issue sets the principle according to which the collation of a transferred immovable property must be take place having regard for its value at the time of the opening of the succession, in order to determine the value of each their shares of the estate, in the case of dissolution of coownership by the heirs. This principle is confirmed especially when the changes in the value of the donated good, taken place between time of the transfer of ownership and time of the opening of the succession, are not effectuated by the owners, as codified by Article 748 of the Italian Civil Code. A functional and systemic analysis of the Article 746, subparagraph 2, of the Italian Civil Code, justifies the necessity to take into consideration all the economic profiles of the donated good existing «at the time of the opening of the succession », independently of changes of ownership.
La sentenza in commento avvalora, consolidandolo, il principio secondo il quale, in ipotesi di scioglimento della comunione ereditaria, al fine di determinare l’esatto ammontare delle quote da attribuire a ciascuno dei coeredi, la collazione di un bene immobile alienato deve avvenire «avuto riguardo al valore di quest’ultimo al tempo dell’aperta successione». Tale principio trova conferma, a maggior ragione, nell’ipotesi nella quale, tra il tempo dell’alienazione e quello dell’apertura della successione, siano subentrati mutamenti di valore del bene donato non ascrivibili al suo titolare ai sensi dell’art. 748 c.c. In quest’ottica, una lettura sistematica ed assiologica dell’art. 746, comma 2, c.c., giustifica la necessità di comprendere ogni aspetto economicamente valutabile «al tempo dell’aperta successione», indipendentemente dai mutamenti di titolarità nel frattempo intervenuti.
