The paper – moving from the recent judgment of the court in Rome – examines the issue of the entitlement to bring an actio interrogatoria, with particular regard to the parties holding a private law position within the succession procedure. Under Article 481 of the Civil Code, in the generic term «chiunque vi ha interesse», should be included both the executor of the estate and «curatore dell’eredità giacente», on the basis of a legally qualified interest in the conclusion of the succession procedure.
Il lavoro, muovendo da una recente pronuncia del Tribunale di Roma, affronta la questione della legittimazione attiva all’actio interrogatoria, con specifico riferimento ai soggetti titolari di un ufficio di diritto civile nell’àmbito del procedimento successorio. Ai sensi dell’art. 481 c.c., nella generica formulazione del «chiunque vi ha interesse » dovrebbero essere compresi sia l’esecutore testamentario sia il curatore dell’eredità giacente, in virtú di un interesse «giuridicamente qualificato» alla definizione del procedimento successorio.
