Rinunzia all’azione di riduzione e operatività dell’art. 524 c.c

The essay – moving from the recent judgment of the Court of Appeal of Naples – examines the question of the protection of the prejudiced legitimate creditors, with particular regard to the usability of the ordinary instruments of revocation and/or surrogacy or, extensively or analogously, of the special device of the appeal of the renunciation of inheritance, on the basis of a functional interpretation of Article 524 of the Civil Code.

Il lavoro, muovendo da una recente pronuncia della Corte d’Appello di Napoli, affronta la questione della tutela dei creditori del legittimario leso o pretermesso, con specifico riferimento alla utilizzabilità degli ordinari strumenti della revocatoria e/o surrogatoria, oppure, in via estensiva o analogica, dello speciale rimedio della impugnazione della rinunzia all’eredità, sulla scorta di un’interpretazione funzionalmente orientata dell’art. 524 c.c.
