La sentenza della Corte Suprema di Cassazione sull'irragionevolezza dell’arresto di Carola Rackete

According to the Supreme Court of Cassation, when on 29 June 2019 the German master of the Sea Watch 3 has delivered in Lampedusa the migrants saved on the high seas, she should not be arrested. The Italian procedural penal code forbids the arrest, should the illegal conduct be committed in order to fulfill an obligation which, in this case, corresponds to the fundamental duty to rescue.

Secondo la Corte Suprema di Cassazione, la Comandante tedesca della Sea Watch 3, quando il 29 giugno scorso ha eseguito lo sbarco a Lampedusa dei migranti salvati in alto mare, non andava arrestata. Il nostro codice di procedura penale vieta l’arresto se il fatto contestato viene eseguito per adempiere un dovere che, nel caso in commento, corrisponde al fondamentale dovere di soccorso.
