The interpretation of the territorial dimension of the right to be forgotten online raises important frictions in the practice of policy makers, data protection authorities, national and international courts. After a preliminary analysis of the legal nature of this emerging fundamental right, we will focus on both sides of the coin, exploring arguments against and in favor of its extraterritorial application. Then, in order to establish how far can the internet forget, we will approach the core issue regarding whether and to which extent this global and universal space can be subject to the traditional exercise of State powers and authority under public international law.
L’interpretazione della dimensione territoriale del diritto all’oblio online genera importanti frizioni nella prassi di legislatori, autorità garanti della privacy e tribunali nazionali e internazionali. In seguito a una preliminare analisi della natura giuridica di questo emergente diritto fondamentale, orienteremo l’indagine sulle argomentazioni favorevoli e contrarie all’applicazione extraterritoriale dell’oblio. Per stabilire fino a che punto internet può dimenticare risulterà poi cruciale chiarire se in base al diritto internazionale pubblico questo spazio globale e universale può essere soggetto al tradizionale esercizio dell’autorità statale.
