This paper comments on some passages of the book by Damiano Canalewith particular reference to its first theoretical part, pointing out the difficulty in connecting the theoretical dimension of law with the practice.In what follows my main concern is to show how the book, notwithstanding its brilliance and clarity, seems not to pay the adequate attention to the socio-political importance of practical cases and the conflicts it engenders.
