Principi costituzionali ed europei in tema di liberalizzazione del servizio tecnico nautico di rimorchio

The essay is focused on the matter of the port tug service and the freedom to provide it. Such issue has been recently submitted to the domestic Courts and this gives the opportunity to make a close scrutiny how the principle of freedom of competition is achieved, within the constitutional and European framework, in the Italian sector of the so called technical-nautical services (ie. port tug services, pilotage, ship mooring services) to affirm the incompatibility of general exclusive rights in the sector.

Il lavoro affronta la questione dell’apertura al mercato del servizio di rimorchio marittimo. La richiesta di esercizio dell’attività di rimorchio in concorrenza ha formato oggetto di una recente decisione nella giurisprudenza amministrativa, che costituisce occasione per criticamente analizzare come il principio di libertà di concorrenza si realizzi, nel quadro costituzionale ed europeo, nei servizi tecnico-nautici ad affermare l’incompatibilità di generali diritti di esclusiva nel settore
