La segregazione di beni in trust e la tutela dei crediti del disponente

The phases which regulate the financial liability are two: the identification of the debtor's assets which might be executed and, the acknowledgment of the creditor's right to participate in the liquidation. The act of distraining the debtor's assets pertains to the first phase. This paper focuses on the effects of the assets segregation and on the instruments for creditors' protection.

Il meccanismo della responsabilità patrimoniale previsto dall’art. 2740 c.c. presuppone due fasi cronologicamente e logicamente successive: l’individuazione del patrimonio suscettibile di esecuzione e l’attribuzione al creditore del diritto di partecipare a diverso titolo all’esecuzione. Il tema della segregazione patrimoniale, al pari di qualsiasi atto dispositivo, attiene alla prima fase. Il contributo si sofferma sugli effetti della segregazione e sugli strumenti di tutela a disposizione dei creditori del disponente.
