The recognition of social rights for legal immigrants shows many issues, also arising from the concomitant involvement of matters as immigration (state exclusive legislative power), social welfare (regional exclusive legislative power), fundamental rights (state/region concurring legislative power). The current situation of uncertainty is exacerbated by the lack of the determination of basic level of benefits relating social entitlements to be guaranteed throughout the national territory, which entails an heterogeneous (and discriminatory) regional system. On these bases, this paper aims at analysing the topic, underlining the opposite dynamics of exclusion and integration which characterise the relationship between the immigrant and the national community. An adequate welfare access system also for the immigrants constitutes an essential prerequisite to guarantee the peaceful development of new pluralist societies: to this aim the implementation of regional integration public policies has to be founded on the mutual recognition of different cultural identities, and has to be directed to the involvement of immigrants communities in the participation in social life, also through the enhancement of a non-formal notion of citizenship.
