The essay aims to read again, in a critical key, an hypothesis of Vico that reconstructs the archaic history of Rome as agricultural laws. In particular, the neapolitan philosopher interpreted the legislation of Servius Tullius and the decemviral legislation as the first two agricultural laws of the history of Rome. The exposition is also supported by a general survey of the most recent perspectives that have emerged in the contemporary debate on the monarchy and proto-republican age of Rome, looking, at the same time, the profile socio-economic, religious and legal too. Finally follow some reflections on the land regime with reference to the monarchical age, the census of Servius Tullius and the XII tables, in order to verify the possibility of recognizing an individual plebeian land property already for this era and its possible juridical consistency.
