Abstract

The contribution intends to highlight the interesting experience of environmental constitutionalism in Morocco, Algeria, and Tunisia. Recent years, especially due to the Arab Spring, have seen a growth in constituent activity in much of the Maghreb. The provisions protecting the environment in the constitutions also benefited from this fervour. In some cases, they have been confirmed, in others new features have been added, in still others small steps backwards. Concepts such as sustainable development, climate change, future generations, the right to water, rational exploitation, responsible consumption, and pollution have made their appearance and entail a new catalogue of commitments for governments and citizens. The latter are recipients of numerous rights related to the environment and this also allows North Africa to be able to act as a study laboratory. Due to its characteristics, this region is particularly sensitive to climate change and for this reason rulers have gradually understood that the well-being of their people is closely linked to the level and quality of their environment. By searching for these precise keywords, refers to offer a brief overview of environmental protection within these three constitutional experiences. The purpose of this small comparison is to enhance a governance model which, despite its operational limits, has had the courage to establish a firm bond towards the fight against climate change and the promotion of sustainable development in a region perennially afflicted by various types of crises.
