This article aims to investigate the Bourdieu’s sociology of the legal field through its relationship with Marx and the Marxism of Althusser and Thompson. On the one hand, it highlights how Bourdieu, despite the permanence of the horizon of Marxian thought, intends to move away from Marx in relation to the role played by law in the classification struggles and in the realpolitik of the universal. On the other hand, it shows how Althusser and Thompson, two competitors in the intellectual field, represent authors from whom Bourdieu intends to distance himself in order to construct his notion of ‘field’. However, in the framework of these problematic relationships, it is precisely the re-evaluation of the legal field in the direction of emancipatory practices that suggests the thinkability in Bourdieu of an indispensable relationship, of Marxian ancestry, between social struggles and the performative role of criticism.

Il presente articolo intende indagare la sociologia del diritto di Bourdieu attraverso il suo rapporto con Marx e con il marxismo di Althusser e Thompson. Da un lato si evidenzia come Bourdieu, pur nella permanenza dell’orizzonte di riflessione marxiano, intenda allontanarsi da Marx in relazione al ruolo giocato dal diritto nelle lotte per la classificazione e nella realpolitik dell’universale. Dall’altro si mostra come Althusser e Thompson, due concorrenti nel campo intellettuale, rappresentino autori da cui Bourdieu intende smarcarsi per costruire la propria nozione di campo. Tuttavia, nel quadro di questi rapporti problematici, proprio la rivalutazione del campo giuridico in direzione di pratiche emancipative suggerisce la pensabilità in Bourdieu di un rapporto irrinunciabile, di ascendenza marxiana, tra le lotte sociali e il ruolo performativo della critica.
