Società benefit e ruolo dell'Autorità garante della concorrenza e del mercato

The role played by the Antitrust Authority in relation to the benefit companies, raises a number of questions concerning the nature of the powers attributed to it and their scope of operation. Issues that on the one hand seem to be answered in the - consolidated - opinion that excludes the AGCM from supervision, but that faced in another perspective could lead to diametrically opposed approaches. This is obviously a hypothesis, for the verification of which it will be necessary to await the application of the discipline that concerns us, by the companies concerned, of the same guarantor Authority and obviously of the interpretations that will provide the jurisprudence.

Il ruolo svolto dalla Autorità garante della concorrenza e del mercato nei confronti delle società benefit, pone una serie di questioni riguardanti la natura dei poteri in proposito attribuitile ed il loro ambito di operatività. Questioni che da un lato sembrano trovare risposta nella opinione – consolidata – che esclude dalla vigilanza l’AGCM, ma che affrontate in altra prospettiva potrebbero condurre ad approdi diametralmente opposti. Trattasi ovviamente di ipotesi, per la cui verifica occorrerà attendere l’applicazione della disciplina che ci occupa, da parte delle società interessate, della medesima Autorità garante ed ovviamente delle interpretazioni che ne fornirà la giurisprudenza.
