Il lavoro affronta il tema delle pene contrattuali alla luce dei princípi di proporzionalità e ragionevolezza e mira a dimostrare che, a fronte di una penale sproporzionata, spetta al giudice esercitare il potere di riduzione, ispirandosi non alla valutazione dell’entità del danno, ma alla concreta situazione contrattuale e all’effettiva incidenza del medesimo sull’equilibrio delle prestazioni.
