Within the complex theme of the relationship between culture and political power in late antiquity, through the analysis of the legislation of the emperor Constantine - who granted immunities and privileges to doctors and professors – and the edictum de professoribus of the emperor Julian, which represent two decisive moments for the fortunes of the school in late antiquity, the paper illustrates similarities and differences between the legislative policies of Constantine and Julian, both extremely attentive to the world of culture and education, that only since Julian’s edict begins to take shape as a real munus publicum.
