In judgment n. 27813/2013, the Supreme Court of cassation addressed, in terms of interpretation, the question of the meaning of “belief” (art. 37, sect. 1, par. B, Code of Criminal procedure) and “opinion” (art. 36, sect. 1, par. C, art. 37, sect. 1, par. A, Code of Criminal procedure), drawing a line between the two distinct expressions when used by the Court. In particular, compared to “opinion”, the Court has attributed to “belief” a narrower field of operations. Following the line of argument of the Court of cassation, the work aims to analyze the key issues forming the basis of the adopted solution.
