The monograph studies regional law and constituzional principles on competence of regional legislative competence (art. 117, paragraph 4, Cost.). Research aims to demonstrate that "regional subjects" can also be cross-cutting contrary to what the doctrine which agrees which states that the c.d. transversality concerns only the the matters covered by state legislative power, in homage to the well-known principles of on the hierarchy of regulatory sources. In reality, the concept of matter presupposes that of competence, and the transversality can by definition cover all competences for both state and regional matters. The transversality, in fact, is resolved in the elasticity of the content of the norms on competence and, that is, it concerns not only the norms relative to the legislative power of the State, but also those having as object the legislative power of the Regions, whereas the hierarchy of sources requires account to be taken of the fact that the constitutional reform of the year 2001 recognised the two legislative and state and regional authorities as equal constitutional dignity. The essay enucleates for the first time the notion of regional legislative competence. Passive transversality, in particular, limits the active transversality of power State legislative power to regional matters only regionali che sono suscettibili di essere incise e attraversate dalla potestà legislativa stata¬le. In turn, regional active transversality is built on the basis of of the same constitutional jurisprudence which has recognised, in matters of exclusive State legislative competence, areas of of legislative power limited to the protection or regional interests or interests related to national interests or interests which are not governed by State legislative competence or interests not adequately protected by state legislative competence so that regional legislative competence can strengthen state protection. The final aim of the research is to guide future constitutional jurisprudence so that it gives concrete application to the principles which it itself sets out in the abstract, with regard to multi level legislation, and therefore, in the future he considers constitutionally legitimate all those regional laws concerning the areas of legislation mentioned above. The theoretical research finds concrete application in the matter of tourism because, with the note judgment n. 80/2013, the Council has, for the first time, ordered the halt to state legislation, which has approved the Tourism Code, for having crossed the subject of tourism with transversal regional legislative competence.
La monografia studia il diritto regionale ed i principi costituzionali in materia di competenza legislativa regionale (art. 117, comma 4, Cost.). La ricerca si propone di dimostrare che anche le “materie regionali” possono essere trasversali contrariamente a quanto ritiene la dottrina la quale concordemente 'afferma che la c.d. trasversalità concerne solo le materie oggetto della potestà legislativa statale, in omaggio ai noti principi sulla gerarchia delle fonti normative. In realtà la nozione di materia presuppone quella di competenza e la trasversalità può riguardare per definizione tutte le competenze per materia sia quella statale sia quella regionale. La trasversalità, invero, si risolve nella elasticità del contenuto delle norme sulla competenza e, cioè, riguarda non solo le norme relative alla potestà legislativa statale, ma anche quelle aventi ad oggetto la potestà legislativa delle Regioni, posto che la gerarchia delle fonti impone di tener conto che la riforma costituzionale dell'anno 2001 ha riconosciuto pari dignità costituzionale alle due potestà legislative e statale e regionale. Il saggio enuclea per la prima volta la nozione di competenza legislativa regionale trasversale, poi, declinata come trasversalità vuoi passiva e vuoi attiva. La trasversalità passiva, in particolare, limita la trasversalità attiva della potestà legislativa statale alle sole materie regionali che sono suscettibili di essere incise e attraversate dalla potestà legislativa statale. A sua volta la trasversalità attiva regionale viene costruita sulla base della stessa giurisprudenza costituzionale che ha riconosciuto, pur nelle materie di esclusiva competenza legislativa statale, spazi di potestà legislativa limitatamente alla tutela o degli interessi regionali o degli interessi connessi agli interessi nazionali o di interessi non disciplinati dalla competenza legislativa statale o degli interessi non adeguatamente tutelati dalla competenza legislativa statale onde la competenza legislativa regionale può rafforzare la tutela statale. Lo scopo finale della ricerca è orientare la futura giurisprudenza costituzionale perché essa dia concreta applicazione ai principi da essa stessa enunciati in astratto, in ordine alla legislazione plurilivello e, quindi, in futuro ritenga costituzionalmente legittime tutte quelle leggi regionali aventi ad oggetto gli spazi di legislazione sopra ricordati. La ricerca teorica trova applicazione concreta nella materia del turismo perchè, con la nota sentenza n. 80/2013, la Consulta ha, per la prima volta, intimato l'alt alla legislazione statale, che ha approvato il codice del turismo, per aver attraversato la materia del turismo di competenza legislativa trasversale regionale.
