The subject of this study focuses on the integral and context-sensitive analysis of the four legal documents known as placiti (or giudicati) campani (or cassinesi, owing to their location in the Montecassino Abbey Archive). Written in three towns of the Principato di Capua between the years 960-963, they have risen to fame because of the presence of formulaic instantiations in the local Vulgar idiom. These oaths are the most ancient attestations handed down in original not only of the Italian language, but also of the whole domain of Romance languages. The author proposes a reconstruction of the historical background and of the legal peculiarities of the four giudicati, with particular attention to the characteristics and value of the land properties disputed in the trials therein transcribed. The results of this reconstruction provide the basis of a largely innovative interpretation of linguistic characters of the four giudicati.

Oggetto del volume è una lettura integrale e contestuale dei quattro documenti giuridici redatti nel principato di Capua negli anni 960-963, indicati come placiti (o giudicati) campani (o cassinesi, perché conservati nell’Archivio della Badia di Montecassino) e celebri perché contengono formule di giuramento nel volgare locale che sono le più antiche attestazioni datate e conservate in originale non solo dell’italiano ma dell’intero dominio linguistico romanzo.
