The Italian Legislative Decree 81/08 (art. 41, comma d) and subsequent updating legislate the previous Convention among State-Regions-Autonomous Provinces, which in the Unified Conference of October, 30th 2007 established which were the jobs with particular risks for “the health, the sureness and the safety of third parties” (art. 1 and Attached 1), the general scheme to be followed to exclude the assumption of drugs and/or psychotropic substances (art. 3), as well the assessment’s procedures (art. 8). The present study reports the results obtained for the toxicological analyses performed in the period January-June 2009. Considering the sensitivity of the matter and the legislation’s critical and/or not sufficiently clear points, the obtained results highlighted a non-homogeneous interpretation, which results in a different policy of the Occupational Physician Responsible (OPR). Starting from the obtained results, the present paper discusses the critical aspects of the toxicological tests execution, and the consequences for the subsequent expression of the findings of suitability for the job at risks.
