Sociologia e genealogia delle classificazioni giudiziarie. Bourdieu e Foucault a confronto

This paper compares the foucauldian genealogy and the bourdieusian sociology in relation to the judicial practices. Both of them practice a form of political problematization of justice, overcome the division between subjectivism and objectivism and carry out an external history of jurisprudence in relation to the processes of subjectivation. The paper shows the specificity and complementarity of genealogy – intended as the analysis of the connection of the heterogeneous at the intersection of several fields – and sociology – intended as the analysis of the production of legitimacy in a specific field. Moreover, criticizing Bourdieu’s observations on the foucauldian concept of network of power, it tries to prove that in Bourdieu there is a resistance to enhance a potentiality of his sociology, that is, the analysis of the joints between two or more fields or between the legal field and the field of power in relation to the production of legitimacy.
